ReplyAnthony - I agree with your comments except that this is a superficial issue. The federal government bears a lot of responsibility for the housing crisis. However, anyone facing having their wages garnished for the next 20 years by the IRS to payoff income tax owed after they were crushed by the housing downturn would not consider this superficial.

ReplySarah - I not suggesting that short sales are a solution to the down market, but simply that already distressed homeowners should not be taxed on debt that is forgiven through short sale, foreclosure or loan modification. While short sales are not something that we want to see in our housing markets, they are a reality and a far better alternative to foreclosure.

I would think the homeowner would need to show proof (i.e. the estimate/contract for the work and cancelled checks/Visa receipts paying for it). I don't think it would be up to a courthouse clerk to make the call. I would think that the subcontractor could still file the lien but the homeowner would be able to get it dismissed if they provided proof of payment in full to the general contractor. Regarding your 2nd question, I think the law is trying to differentiate between commercial and residential property.

ReplySome of the comments imply that real estate agents are self-serving, sellers are liars, and buyers are stupid and need the local government to uncover the dark truths about the house they are about to buy. Talk about blather.
• Most real estate agents are good people who care about the communities in which they work, live and raise a family. And they certainly care about their clients - buyers and sellers.
• Most sellers are not intentionally discharging storm water to the public sewer and then trying to deceive potential buyers about it. Most sellers are quick to agree to address real issues and make great efforts to turn over good houses to buyers.
• Most buyers are actually quite intelligent and capable of bringing in good inspectors to find and resolve the material defects in the home.I know there are real issues especially in boroughs such as Norristown and Pottstown with rental units being in terrible states of disrepair. So again, why wait until they are being sold to address the problem? Those problems are real and need timely resolutions.
FYI – Only about 50% of the municipalities in this area perform U&O inspections on residential re-sales. And of the ones that do, very few look at potential fire hazards such as heating and electrical systems. If they did and there was a subsequent fire, the municipality that “blessed” the house would get sued.

In any market, buyers are supposed to negotiate the best deal they can get on a home sale. Our job when we represent buyers is to do exactly that. The article simply states that the market has turned from a strong buyer's market to a neutral market. Understanding the market is critical to people like you trying to sort through the wide array of unimpressive, overpriced homes and the really good listings which right now are flying off the market. You would be well-served to have one of those real estate professionals represent you and then all those phone calls from other agents trying to persuade you into buying their listing would cease. Stop being so cynical.
